  General sales terms and conditions

These general terms and conditions apply to the sale, via the “Ogone SAS” secure platform, of the publications, software and other products available via the Certu website.

They come in addition to the Certu’s General sales terms and conditions, which may be provided upon request; in the event that the terms and conditions hereunder should contradict the general sales terms and conditions in any way, the former shall take precedence.The terms and conditions relative to use of the “OGONE SAS” secure payment service can be viewed at http://www.ogone.com.

Article 1: Products and services

The catalogue website contains full details of publications and software available for sale online, together with prices. These products and prices are valid as long as they can be viewed on the website and for as long as stocks are available.

Article 2: Placing an order

Instructions on how to place an order are given on the “First visit” page on the website.

Article 3: Payment methods

CERTU is not subjected to the VAT on its sales.(law n°66.10 of 06.01.1966)

There is a choice of 3 payment methods available on the website:

  • payment card (MasterCard and Visa) using “Ogone SAS” secure payment service,
  • by cheque, only for customers in Metropolitan France and the French Overseas Departments and Territories,
  • by direct bank transfer, only for “Public service” customers in Metropolitan France and the French Overseas Departments and Territories,

3.1 – Payment by bank card

By clicking on the button provided on the order form for payment by bank card, the customer validates and confirms the order and declares that s/he has read and agrees to the general sales terms and conditions.
The customer is then redirected to “Ogone SAS” to pay using the secure payment system. An electronic receipt (which can be printed out) will then be issued as proof of the transaction.

3.2 – Payment by cheque

By clicking on the button provided on the order form for payment by cheque, the customer declares that s/he has read and agrees to the general sales terms and conditions.
To confirm the order, the customer MUST print out the order form, sign it and send it, together with a cheque made payable as provided for under Article 6, by post within ten days, to the Certu Sales Office.
Provided everything is in due order, the order will be validated on the day it is received by Certu. During the 10 days following the placing of an order online, all products that are in stock at the time of ordering will be reserved for the customer. Once this 10-day period has elapsed, the order will be cancelled and the products will be made available for other customers.

3.3 – Payment by bank transfer

Bank transfers are reserved for French public service bodies (government departments, local and other public service departments).
By clicking on the button provided on the order form for payment by bank transfer, the customer declares that s/he has read and agrees to the general sales terms and conditions.
To confirm the order, the customer MUST print out the order form, sign it and send it by post or fax within ten days to the Certu Sales Office (Bureau des Ventes).
Provided everything is in due order, the order will be validated on the day it is received by Certu. During the 10 days following the placing of an order online, all products that are in stock at the time of ordering will be reserved for the customer. Once this 10-day period has elapsed, the order will be cancelled and the products will be made available for other customers.
After checking availability, the Sales Office will send the products ordered, together with the invoice, to the address given on the Order Form. Upon receipt, the customer has 45 days to make the bank transfer to the account of the Trésor Public (see details below).

3.4 – Information sent to the Customer during the order process

Following validation of the order via the Net, the customer will be sent confirmation of the order at the email address given. This message contains details of the items ordered and its “status”.
Within seven days at the most, the customer will be sent a second email informing him/her of:

  • product availability and the date set for the order to be dispatched,
  • full or partial cancellation of the order in the event that a product or products is/are unavailable.

Article 4: Delivery

Goods will be delivered by the French postal service, La Poste, to the address given by the customer on the Order Form, within thirty days at the most from the date of ordering.
For information, average delivery times (not legally binding) are:

  • For software: 3 working days from the date of ordering,
  • For hardcopy versions of works in stock: 5 working days from the date of ordering (order checked, processed and shipping order to our external courier service).

 

Article 5: Prices and discounts

All prices given on the website are legally binding.
Prices relative to special offers and the period for which such offers are valid are given on the website.
All prices are given in Euros, including VAT, and including standard packing but excluding postage.
Any discounts applicable to mail order purchases are automatically integrated online (30% discount for a single order for 10 copies of the same work, excluding software).
The cost of delivery to each separate address are set rates, regardless of the quantity and/or the type of items ordered. Details of delivery costs are given in the "shopping basket" after entering the country to which the goods should be sent.
To this end, we recommend grouping all items selected in the "shopping basket" together on a single order: separate orders cannot be combined later during processing and postage will be billed for each separate order.
In the case of deliveries outside the European Union, any customs duties or local taxes must be paid by the customer.

Article 6: Payment

All payments must be made in Euros, by bank card (Carte Bleue Visa, Mastercard or French bank payment cards), by cheque redeemable in France, made out in Euros to CERTU or by direct bank transfer in the case of public service customers.
The customer’s account will be debited:

  • on the day that products are dispatched, in the case of hardcopy works,
  • on the date of ordering in the case of software.

Transactions made by bank card are secure thanks to the “Ogone SAS” system. All information provided by the customer regarding the order and bank details is encrypted to protect confidentiality.

Article 7: Proof of transaction

Information registered on behalf of Certu by “Ogone SAS” through its secure payment platform is deemed proof of all commercial transactions that take place between Certu and its customers.
For payments by cheque and bank transfer, the signed letter sent by the customer and containing the order form shall be deemed proof of purchase.

Article 8: Withdrawal by the customer

In accordance with Article L 121.20 of the French Consumer Code, the customer has the right to return any product to Certu within seven working days of receipt. The customer is liable for return postage costs. To exercise this right, contact:

Certu will reimburse the customer for any goods returned in the form of a credit note within thirty clear days from the date of receiving the returned goods in their original packing.
This right does not apply to software or CD-ROMs on which the customer has broken the sealed packaging.

Article 9: Transport

All goods are shipped at the customer’s risk. The latter should therefore check the contents of the package at the time of delivery and, if necessary, inform the shipper of any reservations within three working days following delivery.

Article 10: Complaints / Liability

Certu is authorised to deal with any complaints or disputes related to the product sold or service provided, or related to delivery or payment. If the complaint relates to payment operations, Certu shall discuss the matter with the bank or third party entrusted to deal with the payment system.
Certu may only be held liable in the case of non-compliance relative to delivery of the order. Any complaint to this end, accompanied by the non-compliant product, should be sent in writing to the address below within eight days of delivery:

Certu shall exchange the non-compliant product as stocks allow or reimburse its cost in the form of a credit note within seven days following receipt of the complaint.
Except as provided for above, Certu shall not be held liable in the case that any of its products or software fail to meet the customer’s needs and practices. Consequently, the customer shall forgo the right to take action against Certu for this reason, and for any loss or damage caused directly or indirectly by the use of Certu’s products or services.

The provisions set out under this Article do not exclude application of the legal warranty provided for under Article 1641 and following of the French Civil Code.

Article 11: Intellectual Property

Certu products and software are original works protected by the law relative to intellectual property.
The acquisition of hardcopy works, electronic documents that are free of charge or for which payment is required (PDF format), shall not entail any transfer to the party acquiring such products of the exclusive property rights attached therein: their use is strictly limited to personal use by the acquirer.
Any other use, notably graphic or digital reproduction, adapted for the purposes of representation or distribution to any third party, either in their original form or as by-products, in any form or by any means or technical procedure whatsoever, must first be authorised in writing by Certu.
The acquisition of “Certu” software is subject to the licence agreement defined under the paragraph entitled “Certu software licence contract”.

Article 12: Personal information – Right of access

In accordance with the provisions of France’s Freedom of information and Data Processing Act, the customer has a right to access, correct and contest any personal information required to process his/her order.
To exercise these rights, the customer should contact Certu (See Legal information page) or the “Ogone SAS” Service.
